This website is operated by Darker Things. Throughout the site, the terms “we”, “us” and “our” refer to Darker Things. Please read these Terms of Service carefully before accessing our website and/or placing an order. By accessing our website and/or placing an order, you acknowledge that you have read, accepted and agreed to be bound by these Terms of Service, without limitations or qualifications of any sort. These Terms of Service are subject to modification without prior written notice at any time in our sole discretion. You should periodically review these Terms of Service to ensure that you remain up to date on all such changes. It is your responsibility to check this page periodically for changes. Your continued use of or access to this website and/or making a purchase from this website following the posting of any changes constitutes acceptance of those changes.
Orders
These Terms of Service will govern our sale of products and/or services to you, and by placing an order with Darker Things, you agree to be bound by these Terms of Service with regard to that order. Once an order is placed, an order cannot be cancelled, modified or rescheduled by you without our consent. We reserve the right to refuse, reject or cancel any order, or to limit the size of any order, at any time at our sole discretion.
Products and Availability
We reserve the right to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We have made efforts to display as accurately as possible the colors and images of our products that appear on our website. We cannot guarantee that your computer monitor's display of any color will be accurate. The color of our fragrances may vary slightly from bottle to bottle. Some of our perfume oils are dark in color and have the potential to stain clothing and/or other fabrics. When using dark-colored perfume oils, take care around white or light colored clothing/fabrics. We are not responsible for any damaged clothing or fabrics of any type that may become stained due to the use or misuse of our products. Availability of our products and/or services is subject to change without notice. If a product is not in stock, we will do our best to advise you when the product will be available. We shall not be liable for any claims or damages arising in connection with products which are out of stock or otherwise unavailable. We reserve the right to discontinue the sale of any product or service at any time without notice to you or any other third party. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected.
Pricing
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the service (or any part or content thereof) without notice. We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the service. In the event a product is listed at an incorrect price due to typographical, photographic or technical error, we reserve the right to refuse or cancel any orders placed for that product listed at the incorrect price.
No Minimum Order
We do not require a minimum dollar amount for orders. The minimum quantity required may vary between products. Promotions may require minimum dollar amounts or purchase quantities to qualify for promotional pricing or products.
Payment Terms
We except secure payments through PayPal only. If you do not have a PayPal account, no worries, simply use PayPal's Guest Checkout. Orders will not begin processing until payment is complete. Your PayPal payment method will be charged at the time any order is placed. You agree to address any and all product and transaction claims solely with us and not to initiate, under any set of circumstances, charge refusals or charge-backs and you agree to indemnify us for any expenses or damages we may suffer on account of the initiation by you of any such charge refusal or charge-back.
Security When Ordering
With PayPal, your payment information is automatically encrypted, ensuring your information is secure when it's stored and/or transmitted. Your data cannot be intercepted during a transaction. PayPal does not share your debit/credit information details with us, the seller. Upon entering your shipping information into our system, Secure Socket Layer (SSL) technology works to ensure your privacy and to assist in protecting your personal data. We use SSL technology to provide you with the safest, most secure shopping experience possible. SSL technology enables encryption (scrambling) of sensitive information during your online transactions. All forms requiring personal information, within our website, are secured with SSL technology so your data stays safe and out of malicious hands.
Shipping
We ship to the contiguous United States only. International shipping, as well as Hawaii and Canada, are not permitted. Any order attempts not within the contiguous United States will not be processed. All completed orders ship within 1-3 business days. If, for any reason, shipping is delayed, we will immediately notify the buyer. Buyer will be notified via email when their order has been shipped. All shipments include a tracking number. We ship to the address you provide to us at time of checkout. If you type in the wrong address, that is where the package will be shipped to. It is your responsibility make sure the name and address where you want your order shipped is correct before completing your purchase with us. If, after placing an order, you notice you have made an error in your shipping information, contact us immediately. So long as your order has not yet been shipped, we can correct it. We will not be held liable for shipments directed to an address other than the shipping address provided by you on the original order. Shipping fees are calculated per order and displayed prior to order completion and collection of payment. All shipping fees are charged at the time the order is placed and are considered final. The shopping cart will reflect combined shipping charges. We shall make every reasonable effort to meet the specified delivery date, but in no case shall we be liable to you if we are unable to meet such date. We authorize shipping carriers to release your package/s without a signature at the delivery destination you provided. If your package status shows delivered and you did not receive your package, it may have been stolen. We are not responsible for stolen packages. A delivery status releases us from all liability. All orders are shipped via USPS Ground Advantage.
Lost or Delayed Package Policy
We do everything in our power to ensure fast, accurate deliveries, but errors can occur. Once packages leave our possession, we have no control over the route USPS uses to deliver your package. In the event that your package is delayed, please reach out to your local post office or local regional post office with your tracking number for assistance on locating your package. We are not responsible for any lost or delayed packages.
Returns and Refunds
For sanitary reasons, and to protect the integrity of our fragrances, perfume oils are non-returnable and non-exchangeable. Scents are widely subjective and each individual interprets fragrances differently. Fragrant notes are provided in the description of each perfume oil to give the buyer an idea of what said fragrance smells like. It is entirely up to the buyer to interpret the scent as they please. Therefore, we do not issue refunds if the buyer does not personally care for the fragrance. However, please contact us immediately if we have made an error with your order. ALL PERFUME OIL SALES ARE FINAL. If you receive an order where we have made an error, please contact us within 48 hours of delivery with the details. Any damage or shortages must be reported within 48 hours of receipt. Photographs of any damage/loss will be requested (including packaging and invoice), so please do not throw package away until after photos have been submitted and the issue has been fully resolved. If a package is heavily damaged upon receipt, please refuse package from carrier. We are not responsible for packages where delivery confirmation has been provided by the carrier.
Unauthorized Use of Products
1) The products sold by us are not intended or authorized for use with any real-time application in which failure of the products could create a situation where personal injury or death may occur. Our products, if not used correctly, can cause fires, injury or even death. Buyer is ultimately responsible for ensuring that you are using all products purchased from us in a safe and appropriate manner. Darker Things shall not be liable for any claims, damages or injuries caused by the use or misuse of any of our products or services by you, the buyer, or any third party to which you provide access to our products.
2) All perfumes, oil-based and non, have the potential to irritate sensitive skin, no matter the brand or manufacturer. Please be aware that fragrances with spice notes (such as cinnamon, ginger, etc) may be irritating to people with sensitive skin. If you experience any skin irritation or redness when using our products, discontinue use immediately and thoroughly cleanse affected area. As with all personal care products, a patch test is highly recommended. Our perfume oils are intended for external, adult human use only. Do not apply our perfume oils to your pets. Do not ingest or allow animals/other humans to ingest our perfume oils. Keep perfume oils out of contact with human/animal eyes. Do not apply perfume oils to the face/lips. Keep perfume oils out of reach from pets and children. Keep perfume oils away from heat/flame. In no event shall Darker Things be liable for any direct, indirect, punitive, incidental, special, consequential damages to property or life, whatsoever arising out of or connected with the use or misuse of our products.
Privacy Policy
Darker Things, under no circumstances, will ever sell or give away any information you have provided to us. We will not provide your private information to any outside or third parties. We will keep in the strictest confidence, any information you provide to us through email, through our online store (by order submission, form submission, etc.), written, mail, or any other form of transmission. This information is limited to Darker Things and will be used solely for fulfillment of your orders. This includes name, address, phone, and product information. We consider this information to be the property of our customers, and will not share, sell, or disclose it to any outside body for any reason. Darker Things does not store any personal payment information.
Indemnification
You agree to indemnify, defend and hold harmless Darker Things and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
